- Shared recreational amenities: Apartment Owner grants Tract 5 Owner and its tenants a non-exclusive easement to use the Apartment Facilities (pool, clubhouse, fitness center, etc.) once Tract 5's proposed facilities are built and certificates of occupancy issued. Similarly, Tract 5 Owner grants Apartment Owner and its tenants an easement to use Tract 5's future walking trail and other recreational areas.
- Cost sharing for facilities: During the Construction & Lease-Up Period (until 90% of Tract 5 units are leased and the Apartment Recreation Easement begins), each owner pays 100% of operating costs and property taxes for facilities on its own property. After that period, combined operating costs are split proportionally by unit count (e.g., 176 apartment units vs. up to 50 Tract 5 units = roughly 78%/22%). Each owner remains solely responsible for property taxes on its own facilities.

- Insurance and liability: Each owner must carry comprehensive public liability insurance naming the other as an additional insured, and indemnify the other for claims arising from its own or its tenants' use of the easements.
