What Greenville Sound Gardens's governing documents say
Greenville Sound Gardens, Phase II is a standard single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). These protective covenants apply to all lot owners, residents, and guests, and are designed to maintain property values and a uniform residential character.
- What you own & maintain: You own your lot and the single-family home on it. You must maintain your lot (mowing, clearing underbrush, keeping improvements in repair) and are responsible for damage you cause to streets, common areas, or other owners' property.
- Architectural review: No exterior construction, alteration, or change of color may begin without written approval from the Declarant or an architectural committee. Plans are reviewed for harmony of design and location; disapproval may be based on purely aesthetic grounds.
- Use restrictions: Lots are for single-family residential use only. No commercial activity, mobile homes, tents, or temporary structures (except during construction). Each lot may have only one detached single-family dwelling with a minimum size of 2,600 sq ft (two-story) or 2,400 sq ft (one-story), plus a two-car garage.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed and escorted when outside, not allowed to run free, and must not become a nuisance. Owners must promptly remove pet waste from common areas and other lots.
- Parking & vehicles: No street parking. Trucks over 3/4 ton, boats, campers, trailers, and similar vehicles must be stored in an enclosed garage and not visible. No junk or inoperable vehicles. No customized vehicles deemed unsightly by the Board or Declarant.
- Leasing & rentals: Leases are permitted, but tenants must comply with all covenants. Owners may delegate their common area use rights to tenants. No specific minimum lease term is stated in this document.
- Assessments & fees: All lot owners must pay general assessments for common expenses, which are set annually by the Board. Special assessments for capital improvements require a 2/3 vote of members. Unpaid assessments become a lien on the lot and may be foreclosed.
- Common areas & amenities: The association owns and maintains common areas (e.g., open space, stormwater systems). Owners have an easement to use common areas for their intended purposes, subject to association rules. Use rights may be suspended for nonpayment or rule violations (up to 60 days).
