What The Cottages at Summerwalk's governing documents say
The Cottages at Summerwalk is a neighborhood of 19 single-family lots within the larger Summerwalk planned community in Wilmington, NC. This document is the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that apply to lot owners in this neighborhood. Owners are also members of the Summerwalk Master Association and must comply with its governing documents and pay additional assessments.
- What you own & maintain: You own your lot and the home on it. The Association maintains the common areas within the neighborhood (e.g., landscaping, private streets, signage). The Master Association maintains larger community amenities. The Association may also enter your lot for lawn maintenance if you default.
- Assessments & fees: Owners pay annual assessments, special assessments (approved by 2/3 vote), insurance assessments, ad valorem tax assessments, a working capital assessment of $350 at purchase, and transfer fees. Assessments are a lien on the lot if unpaid. The Association can also levy assessments to reimburse the Declarant for maintenance costs.
- Voting & control: Each lot gets one vote. The Declarant (developer) holds Class B membership with 3 votes per lot (currently 57 votes) until December 31, 2028, or until it surrenders that status. During that period, the Declarant controls the Board.
- Master Association obligations: All lots are part of the Summerwalk Master Association. Owners must pay Master Association assessments, follow the Master Declaration and Residential Design Standards, and abide by all Master Governing Documents. The Master Association can veto actions taken by the neighborhood Association.
- Easements & access: The Association and Declarant have easements over lots for utilities, drainage, and emergency access. The Association may enter a lot for lawn maintenance if the owner defaults. Police, fire, and emergency services have access to all lots and common areas.
- Insurance: The Association must carry commercial general liability insurance and property insurance on common areas. Insurance premiums are common expenses. Policies must include waivers of subrogation, notice before cancellation, and name each lot owner as an insured.
