The Registry at Vineyard Plantation is a planned community of single-family detached homes in Wilmington, NC, governed by a homeowners association (HOA). The HOA maintains common areas and enforces rules that apply to all lot owners, residents, and tenants.
- What you own & maintain: You own your lot and the home on it. The HOA owns and maintains the Common Area (recreational areas, stormwater facilities, private streets, and utility lines serving multiple lots). You must maintain any Common Area easement on your lot and cannot alter it without HOA approval.
- Leasing & rentals: Leases must be for at least six months and in writing, and must include a clause binding the tenant to the Declaration and HOA rules. Owners must provide the HOA a copy of any lease. If a home is leased, the owner's vote on any matter is limited to 49% weight.
- Architectural review: Before making any exterior changes (building, fence, sign, wall, major landscaping), you must submit plans to the Declarant (or later the HOA) for approval. The Declarant may charge up to $125 per application and has 30 days to respond; if no response, approval is deemed given.
- Assessments & fees: Annual assessments start at $660 per lot (as of 2007) and can increase up to 10% per year without member vote. Higher increases require approval by 2/3 of Class A votes and Class B members. A working capital fee of 1/6 of the annual assessment is due at initial sale. Unpaid assessments become a lien on the lot after 30 days.
