What Elk Run's governing documents say
Elk Run is a single-family residential subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are enforced by the developer (TWA Development Co., Inc.) or, after 1990, by a two-thirds vote of lot owners. The restrictions aim to maintain the community's residential character and attractiveness.
- Residential use only: All lots are for single-family residential purposes only. No house trailer, mobile home, tent, shack, or temporary structure may be used as a residence.
- Minimum house size: Houses must have at least 1,500 square feet of heated floor space with an attached enclosed garage, or 1,650 square feet without a garage (excluding porches, steps, walks, carports, storage areas). The developer may approve a house up to 10% smaller.
- Exterior materials & design: Exterior walls must be conventional frame, brick, clay brick, stucco, vinyl, or exterior composition siding. Concrete block, concrete brick, asbestos siding, aluminum siding, cinder block, and tar paper are prohibited. Roofs must have a minimum pitch of 6/12 unless the developer approves otherwise. Exposed foundations must be brick, stone, stucco, or treated wood.
- Building & site approval: All building plans must be approved by the developer before construction. The developer also controls the site and location of houses, with no specific setback lines but subject to county ordinances. No lot may be clear-cut or substantially cleaned without written consent.
- Fences & landscaping: Fences and hedges cannot exceed 4 feet in height without written approval. Fences are not permitted nearer the front lot line than the rear corners of the house. Chain-link fences are prohibited along street lines on corner lots unless the developer permits them in writing.
- Vehicles & parking: Off-street parking for at least two passenger cars must be provided, with driveways and parking areas made of concrete, brick, asphalt, or landscape paving blocks. No boat, motorboat, camper, trailer, motor home, truck over 3/4 ton, or similar vehicle may remain on any lot unless stored out of sight in an enclosed area or with written permission. No school buses may be parked on streets, lots, or common areas.
- Prohibited activities & nuisances: No noxious or offensive activity, no domesticated farm animals or fowls, no yard or garage sales, no outside radio or TV antennas or satellite dishes without written permission, and no exposed fuel tanks. Garbage receptacles must be screened from street view except on pickup days.
