Kirkwood at Arrondale is a standard single-family home and townhouse subdivision in Wilmington, NC, governed by a homeowner's association (HOA). This document defines the rules and obligations for all lot owners—current and future—setting out what you can and can't do with your property, what you pay for, and how the association operates.
- What you own & maintain: You own your lot and the house on it. The HOA owns and maintains the common areas (everything not under a lot), including private streets, detention ponds, drainage, and community amenities. The HOA also takes care of the entrance landscaping and privacy fences it originally installed. You must keep your front, rear, and side yards neat.
- Assessments & fees: Each lot owner pays an annual assessment—originally capped at $420 per year. The HOA can raise it up to 10% each year without a vote; any increase above 10% needs approval from two-thirds of owners. Special assessments for capital improvements also require a two-thirds vote. There's also a one-time working capital assessment equal to two months' estimated assessment when you buy a lot. All assessments are due 30 days after the due date, with 12% annual interest on late payments, and the HOA can lien your property for unpaid amounts.
- Architectural review: Before you build, alter, or add anything to the exterior—fences, walls, structures, even changes to color or materials—you must get written approval from the HOA Board or its architectural committee. Plans are deemed approved if you don't hear back within 30 days. The minimum house size is 900 square feet of enclosed living area (excluding garages, decks, porches).
- Use restrictions & nuisances: Lots are for single-family homes only, not exceeding one story (unless the architectural committee approves a taller structure). No business activities, noxious activities, junk vehicles, temporary structures (like trailers or tents), boats, campers, or recreational vehicles are allowed on lots unless stored out of sight in a garage or approved by the HOA. No 'For Sale' signs are permitted unless the developer puts them up.
- Pets: You can keep dogs, cats, or other typical household pets, but not for any commercial purpose. Pets must always be leashed and personally escorted when outside—they cannot run free.
- Parking & vehicles: Each lot must have off-street parking for at least two cars, built with concrete, brick, or asphalt. On-street parking is limited to guests. Inoperable vehicles or those without current registration and insurance are banned and may be towed at your expense.
- Exterior standards: All outside light bulbs must be clear, white, or non-frosted. No outside radio or TV antennas without HOA permission. Mailboxes must be the HOA-approved cluster-box type; paper boxes also need HOA approval.
- Pool club: Every lot owner automatically becomes a member of the Kirkwood at Arrondale Pool Club, with dues included in the HOA assessment. The developer can sell up to 40 non-owner memberships (initial monthly dues $30, non-refundable initiation fee, not transferable; membership ends after two months of non-payment).
