Blue Water Townhouses is a townhome community in Carolina Beach, NC, where you own your lot and townhouse and share ownership of common elements through a homeowners association. The association maintains exteriors, roofs, and common areas, and carries master insurance. This declaration covers Lots 7–13 of Phase 2, annexed to the original development.
- What you own & maintain: You own your lot and townhouse in fee simple. The association maintains the common elements, the asphalt shingle roofs, and the exteriors of all townhouses. If damage is caused by your willful act or negligence, you are personally responsible for the cost.
- Association membership & voting: There are exactly 13 memberships, one per lot/townhouse. Each membership is appurtenant to the lot and cannot be sold separately. The Declarant controlled the board until 100% of units were sold or January 1, 1985, whichever came first.
- Assessments & liens: The association prepares an annual budget, and each owner pays 1/13 of the projected costs. Unpaid assessments become a lien on the lot and a personal obligation of the owner. The association can foreclose like a mortgage, but the lien is subordinate to any first mortgage or deed of trust.
- Use of common elements: You have an equal easement to use the common elements, but the association can charge fees, suspend your rights for unpaid assessments or rule violations (up to 60 days), and dedicate or transfer common elements to a public agency.
- Insurance: The association carries fire insurance (with extended coverage, vandalism, and malicious mischief) on all improvements, flood insurance on all lots and townhouses, and public liability insurance. You may carry your own insurance, but it must include a waiver of subrogation.
- Duration & amendment: The covenants run for 20 years from recording (1983), then auto-renew for 10-year periods unless 90% of owners revoke. Amendments require 90% owner approval during the first 20 years, and 75% thereafter.
