Bayshore Crossing is a townhome community in Wilmington, NC, governed by a homeowners association (HOA). Each owner holds fee simple title to their lot and an undivided interest in the common elements. The HOA maintains common areas, drainage, and streets until public acceptance, and owners pay assessments for these services.
- What you own & maintain: You own your lot and the townhome unit. You are responsible for all interior and exterior maintenance of your unit, including doors and windows, but the HOA maintains front and side yard landscaping (including irrigation) and the roof. You must also maintain your own insurance on the unit.
- Leasing & rentals: Leases must be for the entire lot (no renting single rooms) and for a term of at least 12 continuous months. Shorter rentals are prohibited.
- Use restrictions: Units may only be used for residential purposes by a single family. No subdivision of lots is allowed. Activities that are a source of annoyance or interfere with peaceful enjoyment are prohibited.
- Assessments & liens: The HOA levies annual assessments to cover common expenses, including maintenance, insurance, and reserves. Unpaid assessments accrue interest and legal fees, and the HOA has a lien on the lot that can be foreclosed. The developer is exempt from assessments on unsold lots.
- Stormwater management: Each lot has a maximum impervious surface area of 2,000 square feet. A 30-foot vegetated buffer must be maintained between impervious areas and surface waters. Roof drains must terminate at least 30 feet from the mean high water mark. Alteration of drainage requires state concurrence.
- HOA governance & voting: Each lot has one vote. The developer controls the HOA until 90% of lots are sold or December 31, 2014, whichever comes first. After that, owners elect a board of up to seven members for three-year terms. A quorum is 50% of votes, and a majority vote binds all owners.
