Emerald Forest is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1993. These covenants run with the land and bind all current and future lot owners, ensuring the neighborhood maintains a residential character and consistent appearance.
- Residential use only: All lots are restricted to single-family residential use only. No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences.
- Minimum home size: Each residence must have at least 1,700 square feet of heated floor space, excluding porches, steps, walks, carports, and storage areas. A variance of up to 10% below this minimum may be approved by the Declarant.
- Exterior materials: Exterior finishes are limited to conventional frame, brick, clay brick, stucco, vinyl, or exterior composition sidings. Concrete block, concrete brick, asbestos siding, aluminum siding, cinder block, and tar paper composition are prohibited.
- Architectural review: All building plans must be approved by the Declarant before construction. The Declarant also controls the site and location of any structure, and no fence or hedge may be erected without written approval. Chain link fences are prohibited.
- Parking & vehicles: Each lot must have a paved driveway and off-street parking for at least two passenger automobiles. Inoperable vehicles, campers, trailers, trucks over one ton, and similar vehicles are not permitted unless stored out of sight in an enclosed area or with written permission.
- Pets & animals: No domesticated farm animals or fowls may be kept on any lot.
- Yard sales & nuisances: Yard sales and garage sales are prohibited. No noxious or offensive activity may be carried on, and lots must be kept free of unsightly objects, inoperative junk cars, and overgrown vegetation.
