Ashton Townhomes is a townhome community in Wilmington, NC, governed by a homeowners association (HOA). The documents provided are a mix of the full Declaration of Covenants and Restrictions, supplemental declarations, and various policy forms—not a single complete rulebook. The rules bind all lot owners and residents.
- What you own & maintain: You own your lot and living unit. The HOA maintains common areas (front yards, streets, ponds) and provides exterior maintenance for roofs, gutters, exterior surfaces, trees, and shrubs. You are responsible for doors, windows, screens, rear decks, skylights, and landscaping inside rear courtyards.
- Architectural review: Any exterior change—building, fence, wall, landscaping, tree removal, window replacement, or screened patio enclosure—requires prior written approval from the HOA Board or Architectural Review Committee. Submit plans; if no response within 30 days, approval is deemed given.
- Leasing & rentals: Leases must be for at least six months. You may delegate your common area use rights to tenants residing under such a lease.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed and escorted at all times. The Board can expel any pet deemed a nuisance.
- Parking & vehicles: Each lot has designated parking spaces for its owner; other parking is shared. Inoperable vehicles, boats, campers, trailers, and motor homes are not allowed on lots or in parking spaces without Board consent.
- Assessments & fees: Annual and special assessments are levied per lot. A working capital fee equal to two months' estimated assessment is due at closing. Late payments incur interest at 18% per year and a $15 late fee. The HOA can place a lien and foreclose for nonpayment.
- Use restrictions: Lots are for residential use only. No noxious activities, junk vehicles, outside furniture (except on porches/courtyards), 'For Sale' signs (except by developer), temporary structures, or outside antennas without approval. Window coverings must be white or neutral; exterior lights must be clear or white bulbs.
