Belville Office Park is a commercial subdivision within the larger Waterford Business Center in Belville, NC. This declaration governs five lots (9A–9E) and establishes an owners' association for the office park. It applies to lot owners (commercial property owners) and their tenants, not to residential homeowners.
- Permitted uses: Lots may be used for office, professional, or other commercial uses as detailed in Exhibit D. Prohibited uses include residential, industrial, manufacturing, warehouse/storage (except ancillary), pawn shops, flea markets, tattoo parlors, massage parlors (except first-class day spas), auto body shops, and most recreational/amusement venues.
- Architectural review: All improvements (buildings, landscaping, lighting, signs) require written approval from the Architectural Review Committee (ARC) and the Waterford Association. Plans are deemed approved if no response within 30 days. Metal exteriors are prohibited except metal roofs/awnings; no temporary structures except construction trailers.
- Maintenance responsibilities: The Association maintains common areas (roadways, utilities, drainage, detention facilities). Each owner must maintain their lot in a safe, clean condition, including mowing grass to 6 inches or less, removing trash, and keeping buildings and paved areas in good repair. Owners must also maintain landscaping and repair damage caused by their activities.
- Assessments & fees: The Association levies annual assessments to cover common costs, and special assessments for unanticipated expenses or owner-caused damages. Assessments are due as determined by the Board. Delinquent assessments incur late charges, interest, and may lead to a lien and foreclosure. Owners cannot waive assessments by abandoning their lot.
- Insurance requirements: Each owner must maintain commercial general liability insurance with at least $1,000,000 per occurrence and $2,000,000 aggregate, naming the Association as an additional insured. Proof of insurance must be provided within 30 days of request.
- Sign restrictions: No signs painted on building exteriors, no rooftop signs, and all sign equipment must be concealed. Signs must comply with local ordinances. Free-standing signs require ARC approval.
- Parking & vehicles: Minimum parking: 4 spaces per 1,000 sq ft of retail floor area, or 7 spaces per 1,000 sq ft for restaurants, or the number required by zoning, whichever is greater. No on-site septic systems. Pavement markings and directional signs must provide reasonable traffic flow.
- Leasing & rentals: Leases are permitted, but owners must notify the Association of any ground lessee's name and address. Ground lessees may assume certain maintenance obligations, but the owner remains primarily liable.
