What Fuller Court's governing documents say
Fuller Court is a new single-family home subdivision in Bolivia, NC, developed by Brunswick County Habitat for Humanity. This document is the master declaration of covenants, conditions, restrictions, and easements that will govern the community once homes are built and sold. It applies to homeowners (lot owners) and outlines what living here will require.
- Community type & developer: This is a planned community of 10 single-family residential lots, created by Brunswick County Habitat for Humanity, Inc. The association (Fuller Court Subdivision, Inc.) will eventually be run by homeowners, but the developer retains control for up to 25 years.
- What you own & maintain: You own your lot and the home on it. You are responsible for all maintenance of your property, including lawns, landscaping, exterior surfaces, and drainage ditches. The association maintains common areas (if any) and limited common areas.
- Architectural review: All exterior construction, additions, changes (including fences, antennas, awnings, and color changes) must be approved in writing by the Architectural Review Committee (ARC) or Board of Directors. Construction must be completed within one year, and a certificate of occupancy issued within two years.
- Use restrictions: Lots are for single-family residential use only. No mobile homes, above-ground pools, clotheslines, or business activities that are visible or noisy from outside. Only one detached single-family home per lot, and only one family may occupy it as a principal residence.
- Pets: Up to three household pets (dogs, cats, etc.) are allowed, but no livestock, poultry, bees, or exotic animals. Pets must be kept on a leash when outside and cannot be left unsupervised or staked.
- Parking & vehicles: Each lot must provide parking for two cars. No street parking. No commercial vehicles over one ton, boats, trailers, RVs, or unlicensed vehicles may be stored on a lot for more than 24 hours in a seven-day period.
- Leasing & rentals: Renting a residence is prohibited unless the Board of Directors gives written permission. No time-sharing or interval ownership arrangements are allowed.
- Assessments & fees: All lot owners must pay annual assessments, and possibly special assessments, as set by the Board. Delinquent assessments accrue interest up to 18% per year and can become a lien on the property. The developer's lots are exempt from assessments during the control period.
