This is a supplemental declaration for the Townes at Rich Square, a townhome planned community within the larger Brunswick Plantation master community in Bolivia, NC. It creates a sub-association (Rich Square Townhome Association, Inc.) and adds rules specific to this townhome neighborhood, supplementing the master community's rules. The document binds all lot owners, residents, and guests.
- What you own & maintain: You own your lot and townhome unit. The association maintains all exteriors of townhome units and buildings (roofs, siding, gutters), common areas, roads, stormwater facilities, and landscaping in common areas. You maintain your interior, limited common areas (patios, decks), screens, exterior doors, windows, and any landscaping you add. Party walls between units are shared.
- Leasing & rentals: Leases must have a minimum term of six months. The association cannot prohibit leasing or require consent to lease, but can regulate leasing (e.g., minimum term).
- Occupancy & use: Lots are for residential use only. All occupants of a single lot must be a single family (related by blood/marriage/adoption/guardianship, or up to three unrelated persons living as a single housekeeping unit). Home businesses ancillary to residential use are allowed subject to rules.
- Parking & vehicles: Only licensed, operative passenger vehicles (cars, motorcycles, pickups, vans) may be regularly parked in driveways. No regular parking on roadways. No boats, trailers, campers, or RVs on lots or common areas. No vehicle may be used as a dwelling.
- Architectural review: No structures, fences, exterior alterations, or landscaping changes may be made without approval under the master declaration's architectural guidelines. Solar panels are restricted if visible from public areas; installation requires ARC approval and owner indemnification.
- Signs: No signs visible to the public except: marketing/construction signs by the declarant, and professionally prepared for-sale/for-rent signs no larger than 18" x 24". The association may remove non-compliant signs.
- Assessments & fees: All lots pay base assessments equally to fund common expenses. Special assessments may be levied for unbudgeted expenses. Specific assessments can be charged for fines, maintenance costs caused by an owner, or special services. Late fees up to $20/month or 10% of unpaid installment, interest up to 18% annually. Unpaid assessments become a lien on the lot.
- Insurance: The association carries blanket property insurance on buildings and common areas, general liability, workers' comp, D&O, and crime insurance. Owners must insure their own unit interiors, personal property, and liability. In a loss, the owner is responsible for deductibles if caused by their negligence.
