What Oceanside at Oak Island's governing documents say
Oceanside At Oak Island is a planned single-family home community in Bolivia, NC, governed by a homeowners association (POA). The declaration creates a residential subdivision with common areas maintained by the association, funded by annual assessments. It applies to all lot owners and their tenants.
- What you own & maintain: You own your lot and dwelling. You must maintain your lot and improvements, including the right-of-way area adjacent to your lot. The association maintains the common areas (e.g., stormwater facilities, open space) and carries insurance on them.
- Assessments & fees: Annual assessments start at $180 per lot (until 2009) and can increase up to 10% per year without a membership vote. Special assessments require member approval. Unpaid assessments become a lien on the lot and accrue 18% interest and late fees.
- Architectural review: All exterior changes (including fences, landscaping, paint, flags, antennas) must be approved in writing by the Architectural Review Committee (ARC) or association. Plans are deemed approved if not acted on within 60 days. The ARC can charge a review fee.
- Leasing & rentals: No minimum lease term is stated. Leases are allowed, but tenants must comply with all rules. The association can suspend an owner's voting rights for rule violations by tenants.
- Pets: A reasonable number of cats and dogs are allowed but must be kept inside, leashed outside, and not become a nuisance. Owners must clean up droppings. The board can expel animals for ongoing violations or excessive barking.
- Parking & vehicles: Vehicles must be parked on paved surfaces or in garages. No commercial vehicles, inoperable vehicles, boats, campers, or trailers may be kept on lots unless inside a garage and concealed. Car covers are not allowed outside. Violating vehicles may be towed at owner's expense.
- Signs & flags: Political signs up to 24x24 inches are allowed 45 days before an election and must be removed within 7 days after. All other signs are prohibited without association approval. Flags and flagpoles require ARC approval.
- Minimum dwelling size & garages: All homes must have at least 2,600 square feet of enclosed living area (excluding garages, decks, porches). Each home must have an attached two-car garage, and garage doors must remain closed except for entry/exit.
