What Fairway Place's governing documents say
Fairway Place is a small single-family-home subdivision of 6 lots (Ryder Cup Way) in Bolivia, NC. It is not part of the adjacent Caswell Dunes Condominium, but lot owners get a non-exclusive easement to use the private roads and a mailbox station, and may request access to other Caswell Dunes amenities for a fee. This Restated Declaration is the full rulebook for lot owners.
- What you own & maintain: You own your lot and the dwelling unit on it. You are responsible for upkeep of your lot, dwelling, landscaping, and any other structures. Caswell Dunes maintains the private roads and common areas it owns; LINC maintains the stormwater system.
- Annual fee & liens: Each lot owner pays an annual $300 maintenance fee (subject to increase) to Caswell Dunes for road and common-area upkeep. Unpaid fees accrue 5% monthly late fees and can result in a lien on the lot.
- Leasing & rentals: Lot owners may lease their lot/dwelling to tenants. Tenants must follow all covenants and rules. The owner remains liable for maintenance fees and violations.
- Architectural & design standards: Dwellings must be single-family, 1,500–2,500 sq. ft. of heated space, with an enclosed garage for at least one car. No mobile/modular homes, detached structures, in-ground/above-ground pools, boundary fencing, or dog runs. One small hot tub (≤100 sq. ft.) is allowed with privacy screening and permits. Setbacks per plat. No separate architectural review board approval is needed beyond these standards.
- Pets & animals: Only traditionally domesticated pets (e.g., cats, dogs) allowed. Livestock, wild, or dangerous animals are prohibited. Pets must be leashed and supervised outside the dwelling.
- Parking & vehicles: Boats, trailers, and recreational vehicles must be stored inside the enclosed garage. Abandoned, unregistered, or inoperable vehicles must be kept in the garage and are a nuisance if parked outside.
- Stormwater restrictions: Each lot has a maximum built-upon area (e.g., Lot 48: 3,050 sq. ft.). Altering drainage, filling vegetated conveyances, or piping runoff through the 50-foot vegetated setback is prohibited. Roof drainage must be dispersed flow beyond the setback.
- What this document doesn't cover: This document does not set age restrictions, income/affordability limits, or specific rules about trash pickup schedules, holiday decorations, or short-term rentals (leases of any duration are allowed).
