What Herons Nest's governing documents say
This is a set of governing documents for Heron's Nest, a single-family home subdivision in Oak Ridge, NC (Guilford County) and also a separate subdivision in Bolivia, NC (Brunswick County). The documents include restrictive covenants, a supplement about stormwater and rentals, and an addendum for Phase 4. They bind all lot owners and are relevant to homeowners, buyers, and builders.
- What you own & maintain: You own your lot and the single-family home on it. The Homeowner's Association maintains the common areas (walking trails, subdivision signs, lake, dam) and carries liability insurance on them. Annual HOA dues are $100 initially, subject to change.
- Architectural review: All building plans, including site preparation, must be approved in writing by the Declarant before construction. Plans are deemed approved if not disapproved within 30 days of submission. Exterior wall veneers must be at least 75% brick or stone; roof pitch must be at least 9/12 with architectural shingles. Driveways must be concrete, brick, or approved decorative material, at least 12 feet wide.
- Construction timeline: Construction must commence within one year of lot purchase and be completed within 12 months of starting. No construction before 7:00 AM or after 7:00 PM Monday through Friday, and none on weekends. Interior work not audible outside is exempt.
- Pets: Limited to two dogs and two cats per lot. Dog houses must not be visible from the road and require advance approval. Dogs must be leashed when off the owner's lot.
- Parking & vehicles: No trucks larger than a pick-up, no RVs, boats, or trailers allowed on lots unless parked inside a closed garage. All resident vehicles must be parked in the garage or on the concrete driveway. No street parking. No commercial vehicles. Motorcycles, ATVs, and non-licensed vehicles cannot be operated in the development except on the owner's lot without creating a nuisance.
- Leasing & rentals: An owner may lease or rent a portion of a dwelling unit only if that portion is an 'over the garage' dwelling space, and must comply with all applicable laws and the Declaration's other leasing provisions.
- Stormwater & environmental restrictions: Each lot has a maximum built-upon area (BUA) as specified in the supplement (e.g., 2,465 sq ft for some lots). No filling or piping of vegetative conveyances. A 50-foot vegetated buffer must be maintained between impervious areas and surface waters. Roof drains must terminate at least 50 feet from mean high water mark. Tree removal of trees 8 inches or more in diameter requires written permission.
- What this document doesn't cover: These documents do not specify any age restrictions, rental caps or minimum lease terms (beyond the 'over the garage' allowance), or detailed rules about satellite dishes beyond size and placement. The stormwater supplement applies only to the Brunswick County property; the Guilford County covenants do not include stormwater provisions.
