What Tidewater at Ocean Isle's governing documents say
Tidewater At Ocean Isle is a single-family home planned community in Bolivia, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) binds all lot owners and their tenants, guests, and invitees. It establishes the HOA, common areas, assessments, design review, and use restrictions for the 78 lots.
- What you own & maintain: You own your lot and the building on it, and you are responsible for exterior maintenance, landscaping, and irrigation of your lot up to the roadway. The association maintains all common areas, including private streets, ponds, bulkheads, and amenity packages (e.g., pier facilities, pools).
- Assessments & fees: Annual assessments started at $675 per lot in 2008 and can increase each year. The board proposes a budget; it is ratified unless 67% of all members vote to reject it (or 80% if the increase is under 110% of the prior year). Special assessments for capital improvements require a 2/3 vote of members. A working capital assessment equal to three months of annual assessments is due at closing for new lot purchases.
- Leasing & rentals: Leases must be for at least six months, and you cannot lease less than the entire building. Transient or hotel purposes are prohibited. All leases must be in writing and state that the tenant is subject to the declaration and bylaws.
- Architectural review: A Design Review Board (DRB) appointed initially by the developer must approve all construction, landscaping, fencing, and exterior alterations. Minimum heated living area is up to 1,800 square feet. Fencing is allowed only in rear yards and must be approved; chain link, split rail, and welded wire are prohibited. No tree over 12 inches in diameter at ground level may be removed without DRB approval.
- Use restrictions: Lots are for single-family residential use only. No business, trade, or profession is allowed, though home offices without customer visits are permitted. No yard sales, outdoor clotheslines, or outside burning (except grills) are allowed. No commercial trucks, boats, or trailers may be parked on streets or common areas without permission; they must be stored in an enclosed garage or screened.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be kept inside the building or in an area approved by the DRB. No livestock or poultry is permitted.
- Signs & political signs: No signs, including political signs, may be displayed without DRB or declarant approval. The document specifically notes it regulates or prohibits the display of political signs.
