Cape Fear Landing is a single-family home HOA in Bolivia, NC. This document is the Declaration of Covenants, Conditions and Restrictions for Phase 2, which binds all lot owners, tenants, and occupants. It covers architectural standards, use restrictions, assessments, and association governance.
- Land use & building type: All lots are for single-family residential use only. No building may exceed 40 feet in height. Each house must have at least 1,600 square feet of enclosed heated dwelling area (excluding garages, decks, porches).
- Architectural review: Any new construction, exterior alteration, fence, or other structure requires prior written approval from the Board or an architectural committee. Plans are deemed approved if not acted on within 30 days of submission.
- Setbacks & impervious surfaces: Minimum setbacks: front 25 feet, side 4 feet, rear 10 feet. Specific lots at 140 and 148 Yacht Basin have limits on impervious surface area (1,594 sq ft and 1,430 sq ft respectively). Swales may not be filled or piped except for driveway crossings.
- Construction timeline & debris: Exterior of houses must be completed within 12 months of starting construction, unless delayed by strikes, fires, or natural calamities. During construction, lots must be cleared of debris at least once a week.
- Parking & vehicles: Each lot must provide off-street parking for at least 2 cars, surfaced with concrete, brick, or asphalt. On-street parking is limited to guests. Boats, campers, trailers, and similar vehicles are not allowed on lots unless stored out of sight in garages. Inoperable or unregistered vehicles may be towed at owner's expense.
- Pets & animals: No livestock or poultry. Dogs, cats, or other household pets are allowed but not for commercial purposes. Pets must be leashed and personally escorted at all times.
- Signs & antennas: For-sale signs may be no larger than 12 by 16 inches. Outside radio or TV antennas require Board approval. Exterior light bulbs must be clear, white, or non-frost.
- Assessments & fees: Each lot owner pays a pro-rata share (1/7) of common area operating expenses. Annual assessments may increase up to 10% per year without a membership vote. A $300 working capital assessment is due at lot conveyance. Special assessments for capital improvements require 2/3 owner approval. Unpaid assessments bear 12% annual interest and become a lien on the property.
