Lucas Cove is a single-family home community in Oak Island, NC, governed by a homeowners' association (the Lucas Cove Property Owners Association). All lots are for single-family residential use only, and the developer retains exclusive building rights until all lots are sold. The community includes common areas, boat slips, and stormwater management facilities that the association maintains.
- Land use & building type: All lots are for single-family residential purposes only. The developer may use lots for sales or model homes until all lots are sold. No temporary structures, trailers, or commercial vehicles are allowed.
- Architectural review: No building, fence, landscaping change, or tree removal may begin without written approval from the developer (or later the association's board or architectural committee). Plans must be submitted and approved within 30 days. Minimum enclosed dwelling area is 1,500 square feet (excluding garages, decks, porches).
- Developer control & builder restriction: The developer is the exclusive builder of all residences. No other general contractor or homeowner acting as their own contractor may build without the developer's written consent.
- Assessments & liens: All lot owners must pay regular annual assessments and may be subject to special assessments approved by two-thirds of members. Unpaid assessments become a lien on the lot and may be foreclosed. The association may also charge late fees, interest, and suspend voting rights.
- Use restrictions: No noxious activities, inoperable vehicles, or junk vehicles are allowed. Pets (dogs, cats, or other household pets) are permitted but must be leashed and not kept for commercial purposes. Recreational vehicles and boats may be parked only in designated areas under the home with association consent.
- Stormwater & environmental restrictions: Each lot has a maximum built-upon area (impervious surface) ranging from 1,700 to 3,000 square feet per lot (see Exhibit C). A 30-foot vegetated buffer must be maintained between impervious areas and surface waters. No alteration of drainage or stormwater facilities without state approval.
- Common properties & boat slips: All owners have an easement to use common properties, including designated parking and boat slips (Wet Slips 1–16). The association maintains common areas and stormwater systems. Voting rights may be suspended for rule violations up to 30 days.
- Parking & vehicles: Only personal passenger vehicles are allowed on lots. No commercial vehicles exceeding ordinary passenger size. No parking on common areas or rights-of-way for more than 24 hours without association consent. All houses must provide ground-level parking under the living area.
