- Permitted uses & restrictions: Lots may be used for any use allowed by New Hanover County zoning except specifically prohibited uses: agricultural, kennels, body piercing, tattoo businesses, video poker, sanitary services, adult entertainment, funeral homes, fraternities/sororities, circuses, carnivals, fairs, demolition/landscape landfill, and recycling facilities. The Committee has sole discretion to approve or disapprove based on harmony with surroundings, completeness of plans, and the best interests of the development. Decisions are final.
- Assessments & fees: General assessments start at $100/month per lot, can increase up to 10% per year until Dec 31, 2004, and thereafter are set by the Board. Special and individual assessments may also be levied. Unpaid assessments become a lien on the lot and a personal obligation of the owner at the time they fell due. The Association may also charge an impact fee for construction plan review.
- Common expenses & shared maintenance: Common expenses include maintenance of driveway connections, deceleration lane, stormwater/sewer systems, and other common areas. Expenses are allocated among lots by fixed percentages: Lot 1 (19%), Lot 2R (36%), Lot 3 (23%), Tract 2 (22%). Special allocations apply to certain easement taxes and maintenance.
- Parking & vehicles: No damaged vehicles may be parked or stored in open areas. Delivery vehicles (trucks, trailers, vans) may not remain in front of buildings for extended periods. Parking areas, driveways, and roads must meet government requirements.
- Landscaping & signage: All property must be landscaped per approved plans, kept trimmed and free of trash. Signs require Board approval. All secondary power and communication lines must be underground.
- Construction rules: Construction must be substantially completed within 12 months of start unless the Committee approves otherwise. Adequate portable toilets must be provided. Rubbish must be collected and disposed of. No temporary buildings without Committee approval. No outside storage except on Tract 2 and Lot 2R unless Board-approved.
