This is a conservation declaration for Tidalwalk, a subdivision in Wilmington, NC. It permanently restricts designated wetland and riparian areas (Protected Areas) to remain in their natural condition as a condition of a U.S. Army Corps of Engineers permit. The document binds all current and future owners of lots within Tidalwalk, but it is not a full set of HOA rules—it only covers the conservation areas.
- Protected Areas & prohibited activities: The Protected Areas (14.27 acres of wetlands and buffers) must be kept in a natural, scenic, and open condition. Prohibited activities include construction, grading, vegetation removal, dumping, vehicle operation, and any use that would impair conservation purposes.
- Boardwalk exception: The developer or its designee (including any future homeowners association) may build and maintain one pile-supported boardwalk no more than 6 feet wide and at least 3 feet above the ground within the Protected Areas. There is no obligation to build it, and it may be removed.
- Enforcement & public access: The U.S. Army Corps of Engineers can enforce this declaration and inspect the property with reasonable notice. The public does not have a right to enter the Protected Areas.
- Amendment restrictions: This declaration cannot be modified, amended, or terminated without the written consent of the U.S. Army Corps of Engineers.
