Egret Point Subdivision is a single-family home community in Wilmington, NC, governed by restrictive covenants that run with the land and bind all lot owners. These rules promote a uniform residential character and cover building standards, land use, and maintenance.
- Land use & residential only: Lots may be used only for residential purposes. No portion of a lot may be used as a public or private roadway, except for a driveway incidental to residential use.
- Building size & type: Only one detached single-family dwelling (max two stories) and a private garage (max one story, no living quarters) per lot. Minimum heated living area is 1,200 square feet (excluding porches, garages, carports). No garage apartments, temporary structures, trailers, mobile homes, tents, shacks, barns, or other outbuildings are allowed.
- Setbacks & location: Buildings must be at least 50 feet from the front street line and at least 10% of the average lot width from side lot lines. Eave overhangs up to 3 feet and uncovered stoops/steps are allowed within setbacks. Owners of adjoining lots may combine them for one residence, treating interior boundaries as not side lines.
- Architectural review: Plans for all dwellings and structures must be approved by the developer or their successors. If no response is received within 20 days of submission, plans are deemed approved as long as the structure is in general conformity with others in the subdivision.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, or other household pets are allowed if not kept for commercial purposes and not in numbers or nature that become a nuisance.
- Vehicles & nuisances: No commercial trade, noxious activity, or nuisance. Unsightly, inoperative junk cars and similar eyesores are prohibited and may be removed at the owner's expense. No sign boards except 'For Sale' or 'For Rent' signs no larger than 2 feet by 3 feet.
- Maintenance & debris: Yards must be properly maintained; if not, the developer may clean them at the owner's expense. No dumping of rubbish, trash, or garbage except in sanitary containers. After fire or casualty, debris must be removed within 90 days.
- Duration & amendments: These restrictions remain in effect until December 31, 2015, unless amended earlier. Amendments require a written document executed by the developer (or successors) and owners of at least 60% of the lots, recorded in the county register of deeds.
