The Willows is a master-planned community in Wilmington, NC, governed by a Master Property Owners Association. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) applies to all lot owners in the community, including owners of single-family homes and townhomes. It establishes the association, property rights, assessments, use restrictions, architectural control, and conservation areas.
- What you own & maintain: You own your lot and dwelling. The association maintains common elements (e.g., private roads, stormwater ponds, open space) and, for townhomes, limited common elements like roofs, exterior surfaces, and yards. Each owner must keep their lot free of weeds and in good repair.
- Assessments & fees: All lot owners pay annual common element assessments. Townhome owners also pay limited common element assessments. Special assessments require 2/3 vote of affected members. A $200 working capital assessment is due at closing from the developer. Assessments are a lien on the lot if unpaid.
- Leasing & rentals: Leases must be for at least 12 months. Transient rentals are strictly prohibited. All leases must be in writing, include a clause requiring tenant compliance with rules, and be submitted to the association.
- Architectural review: No exterior changes (including painting, fences, or structures) may be made without written approval from the Architectural Control Committee. Plans are deemed approved if not acted on within 30 days. The committee has sole discretion over aesthetics.
- Parking & vehicles: Each lot must provide off-street parking for at least 2 cars. Boats, campers, trailers, and inoperable vehicles are not allowed on lots or streets without association consent. Vehicle repairs may only be done in garages, not visible from the street.
- Pets & animals: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed or controlled and not become a nuisance. Livestock and poultry are prohibited.
- Conservation area: A 12-acre conservation area is permanently restricted to natural, undeveloped use. No construction, vegetation removal, vehicles, or dumping is allowed. The U.S. Army Corps of Engineers may enforce these restrictions.
