Sedgefield is a single-family home subdivision in Wilmington, NC. These restrictions apply to all lot owners and run with the land. The document sets rules for residential use, building setbacks, minimum square footage, and architectural review.
- Residential use only: All lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories), a private garage for up to 3 cars, and incidental outbuildings (including servants' quarters) are allowed.
- Setbacks & building placement: Front setback: at least 50 feet. Side setbacks: 10 feet for one-story, 15 feet for two-story. Rear setback: 25 feet. Unattached garages/outbuildings must be at least 100 feet from the front lot line and 5 feet from side lot lines.
- Minimum floor area: Each dwelling must have at least 1,250 square feet of floor area, excluding porches, garage, terrace, and outbuildings.
- Nuisance & pets: No noxious or offensive trade/activity is allowed. Only household pets (no other domesticated animals) are permitted.
- Temporary structures & trailers: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence. No temporary structures may be used as a residence.
- Sewage disposal: Until a sewerage system is available, septic tanks must meet NC State Board of Health approval. Once available, sewerage disposal must use the system.
- Architectural review: Plans for all dwellings and structures must be approved by a building committee (3 members: owner or rep, plus two elected by lot owners for 4-year terms, with one initial 2-year term). The owner has authority to approve or disapprove committee decisions.
- Duration & amendment: These covenants run with the land until January 1, 1983, then automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
