Council Heights is a single-family home subdivision in Wilmington, NC, governed by a declaration of restrictions recorded in 1955. These covenants run with the land and apply to all lots (1–35) in the subdivision, binding current and future owners.
- Residential use only: All lots are designated for residential use only. No structure other than a dwelling (max 2.5 stories), a two-car garage, and incidental outbuildings is permitted.
- Setback & size requirements: Buildings must be at least 50 feet from the front lot line and 12 feet from side lot lines (except Lot 1, which requires developer approval). The main dwelling must have a ground floor area of at least 850 square feet, excluding open porches and garages.
- Architectural review: Plans for any residence must be approved by the developer (or their successor).
- Temporary structures & trailers: No trailer, tent, basement, shack, barn, or other temporary structure may be used as a residence. Garage apartments are allowed only after the main building is completed.
- Nuisance & activities: No noxious or offensive trade or activity may be conducted on any lot, nor anything that becomes an annoyance or nuisance to the neighborhood.
- Sewage disposal: Until municipal sewerage is available, sewage must be disposed of by septic tanks approved by the North Carolina State Board of Health.
- Pets & animals: Only cats and dogs as family pets are allowed; no other animals, poultry, or fowl may be kept or housed on the property.
- Duration & amendment: These covenants run for 25 years from the recording date (1955) and automatically renew for successive 10-year periods unless a majority of lot owners record an instrument to change them.
