What Sea Dunes III's governing documents say
Sea Dunes III is a timeshare (interval ownership) condominium at Carolina Beach, NC, where you buy the right to occupy a specific unit during one or more fixed weeks each year. This document creates the timeshare plan and binds all owners of those 'Unit Weeks.'
- What you own & use: You own a 'Unit Week' — a deed giving you the exclusive right to occupy a specific condominium unit for a set seven-day period each year (e.g., Unit Week #1 starts the first Saturday). You also own an undivided 1/50 interest in the unit as a tenant-in-common with other week owners, with full ownership vesting in 2026.
- Pets: No pets of any type are allowed in the premises. Violators are charged a $250 clean-up fee, which becomes a lien on their Unit Week.
- Leasing & rentals: You may rent out your Unit Week, but you must comply with the rules. The document does not specify a minimum lease term.
- Fees & assessments: Each owner pays a share of real estate taxes, insurance, utilities, maintenance, and management fees. Payments are due by January 10 (for weeks 1–26) or July 10 (for weeks 27–52), and at least 10 days before your week starts. Late payments accrue interest at the maximum legal rate.
- Management & agent: An agent (initially Gene Ritch Realty for 3 years) manages the property, collects fees, enforces rules, and represents the unit in the condominium homeowners' association. The agent is appointed by a majority of owners.
- Alterations & maintenance: Owners cannot make improvements, decorations, or repairs to the unit or common furnishings without the agent's or all owners' consent. Exterior alterations are controlled by the condominium's homeowners' association.
- What this document doesn't cover: This is a timeshare declaration; it does not cover the broader condominium association's rules (e.g., parking, noise, common area use) or any rental restrictions beyond the timeshare structure. Those are governed by the separate Master Condominium Declaration.
