Pinfish Condominiums, Phase I is a small condominium community in Carolina Beach, NC, consisting of one building with two residential units. This declaration establishes the condominium regime under the North Carolina Condominium Act, defining unit ownership, common elements, and association governance. It applies to unit owners, who each own a unit and an undivided 50% interest in the common elements.
- What you own & maintain: You own your unit's interior space, including finished surfaces, interior partitions, and fixtures within the boundaries. The association maintains the common elements (land, building structure, roofs, corridors, parking areas, etc.) and limited common elements (exterior doors, windows, decks, patios, and HVAC components) except that unit owners are responsible for maintenance and repair of HVAC limited common elements serving their unit, and for replacing broken glass in windows that are common elements.

Structural alterations require prior written consent of the executive board. The owner bears all costs and must indemnify the association.
- Assessments & common expenses: Each owner contributes 50% of common expenses, collected at least quarterly. Unpaid assessments become a lien on the unit after 30 days. The association may levy assessments for insurance, taxes, and maintenance of facilities.
- Insurance: The association must maintain property insurance on the building and improvements at replacement cost, and public liability insurance with minimum limits of $500,000 per person and $1,000,000 per occurrence. Owners are responsible for insuring their own personal property and obtaining additional coverage as desired.
