Huntington Forest is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictive Covenants recorded in 1987. These covenants run with the land and bind all lot owners, covering residential use, building standards, and property maintenance.
- Residential use only: All lots must be used for residential purposes only; no commercial use is allowed.
- Building restrictions: Only detached single-family dwellings up to 2.5 stories are permitted, with a minimum of 1,000 square feet (exclusive of porches, garages, etc.). Accessory buildings (e.g., detached garages) are allowed but cannot be built before the main house and cannot be used as residences.
- Architectural review: Building design must be approved by the Declarant (or its designee). The Declarant has 20 days to approve or disapprove plans; if no response within 20 days, approval is not required as long as the design is in harmony with existing structures.
- Setbacks: No building may be closer than 35 feet to the front property line, and no closer than 10% of the lot's front width to any side boundary.
- Prohibited structures and uses: No trailers, mobile homes, tents, shacks, garages, barns, or other outbuildings may be used as residences. No fuel tanks exposed to view. No satellite dishes, chain-link or wire fences in front yards. No inoperable or unregistered vehicles. No noxious or offensive activities, and no domesticated farm animals or fowls.
- Landscaping and tree removal: Trees over 3 inches in diameter (measured 1 foot above ground) and other vegetation may not be removed without prior written approval from the Declarant. This restriction expired 20 years from the 1987 recording date (i.e., in 2007).
- Maintenance and nuisances: Lot owners must keep buildings and grounds clean and well-maintained to avoid decreasing neighborhood beauty. Unsightly junk cars and unkempt conditions are prohibited.
- Duration and amendments: The covenants run for 20 years from 1987 and automatically extend for successive 10-year periods unless a majority of lot owners vote to revoke or amend them. Amendments can be made at any time by a majority vote of lot owners.
