Greenville Heights Extension is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1969. These covenants run with the land and apply to all lot owners, setting rules for residential use, building setbacks, minimum house size, and property maintenance.
- Permitted use & structures: Lots are for single-family residential use only. Each lot may have one detached single-family dwelling (max 2.5 stories), a private garage for up to 3 cars, and incidental outbuildings including servant's quarters.
- Minimum house size: Dwellings must have at least 1,000 square feet of heated floor space plus a one-car carport. The developer may allow a minimum of 1,248 square feet if an enclosed garage is included.
- Setbacks & fences: Buildings must be at least 40 feet from the front property line, 10 feet from side boundaries, and 20 feet from side street lines. Fences cannot extend beyond the front setback line and cannot exceed 4 feet in height.
- Architectural review: Plans for all dwellings and structures must be submitted to the developer (or its agent) for written approval within 10 days; failure to approve within that time constitutes automatic approval.
- Nuisances & maintenance: No noxious or offensive trades, farm animals, or fowls are allowed. Yards must be properly maintained; inoperative junk cars and similar eyesores are prohibited.
- Signs: Signs are limited to 'For Rent' or 'For Sale' signs no larger than 2 feet by 3 feet.
- Duration & amendment: These covenants originally ran until November 1, 1999, and automatically extend for successive 10-year periods unless 60% of lot owners vote to change them.
- What this document doesn't cover: This document does not create a homeowners association, set dues or assessments, regulate leasing terms, or restrict the number of pets (beyond farm animals). It also does not address parking on streets or common areas.
