Clarendon Park is a planned single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). The HOA maintains common elements like roads and stormwater ponds, and may also maintain certain exterior features of homes (Limited Common Elements) in some sections. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners.
- What you own & maintain: You own your lot and home. The HOA maintains common elements (roads, perimeter fencing, stormwater ponds). In some sections (called Limited Common Element Developments), the HOA also maintains the exterior of dwellings (roofs, siding, decks, porches, gutters, yards) and privacy fences, but not the fenced yard area.
- HOA assessments: All lot owners pay annual Common Element Assessments. Owners in Limited Common Element Developments pay an additional Limited Common Element Assessment. Special assessments for capital improvements require a 2/3 vote of affected owners. The first working capital assessment is $0.00. Assessments are a lien on the lot if unpaid.
- Architectural review: The HOA's Executive Board (or an appointed Architectural Control Committee) must approve exterior changes. During the Declarant Control Period, the developer appoints the committee.
- Developer rights & future expansion: The developer retains special rights (Declarant Control Period) until 2020 or earlier conditions. The developer can annex additional property, amend the declaration without owner approval in certain cases, and use lots for sales offices and models.
- Insurance: For townhouse developments (if any), the HOA must carry casualty and liability insurance. For single-family lots, owners buy their own insurance. The HOA may insure common elements.
- Easements & access: The HOA and developer have easements over the front, rear, and side 10 feet of each lot for utilities and drainage. The HOA may enter lots for maintenance if the owner fails to maintain, and for emergencies.
- Voting & membership: Each lot gets one vote. The developer initially has three votes per lot owned (Class C membership), which ends when non-developer votes equal developer votes, or by 2020, or voluntarily.
