This is a set of restrictive covenants for a small subdivision of four residential lots in New Hanover County, North Carolina, known as the Division of Land for Jo Ann Harrelson. The rules apply to all lot owners and are designed to maintain a uniform, single-family residential character.
- Permitted use & structures: Lots may only be used for residential purposes. Only one detached single-family dwelling (max two stories) and a private garage for up to two cars are allowed. Garage apartments are prohibited.
- Minimum house size: Each dwelling must have at least 864 square feet of heated living area (excluding porches, garages, and carports), measured from exterior walls.
- Setbacks & location: Buildings must be at least 25 feet from the front street line and 10 feet from side lot lines. Eaves may overhang up to 3 feet, and uncovered stoops/steps are allowed within setbacks.
- Architectural review: Plans for all dwellings and structures must be approved by the developer (or successor). If no response is given within 20 days of submission, plans are deemed approved as long as they are in general conformity with other structures in the subdivision.
- Pets & livestock: No livestock (hogs, cattle, horses, poultry, etc.) may be raised or kept. Dogs, cats, and other household pets are allowed but not for commercial purposes and must not become a nuisance.
- Vehicles & parking: Unsightly, inoperative junk cars and similar eyesores are prohibited and may be removed by the developer at the owner's expense.
- Fences & signs: Fences or obstructions over 4 feet high cannot extend nearer the street than the front corners of the house. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 5 square feet.
- Stormwater & utilities: Each lot is restricted to 3,500 square feet of built-upon area (including impervious surfaces). The developer reserves easements for utility lines and drainage.
