This is a declaration of restrictions for a four-lot subdivision in New Hanover County, North Carolina, known as DIVISION OF LAND FOR BOBBY W. HARRELSON. The rules apply to all owners of Lots 1, 2, 3, and 4 and are intended to ensure residential use and uniform development.
- Permitted use: All lots are restricted to residential purposes only. No commercial, noxious, or nuisance activities are allowed.
- Building & dwelling requirements: Only one detached single-family dwelling (max 2 stories) and a private garage (max 1 story, not for living quarters) per lot. Minimum heated living area: 864 sq ft (excluding porches, garages, carports). A garage for up to 2 cars is required unless the developer waives it in writing.
- Setbacks & impervious cover: Front setback: at least 25 ft from street line. Side setback: at least 10 ft (unless adjoining lots are combined). Maximum impervious cover per lot: 3,500 sq ft (includes foundation, driveways, accessory buildings).
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, or other household pets are allowed but not for commercial purposes and not in numbers that become a nuisance.
- Vehicles & parking: No inoperative junk cars or eyesores may be maintained on any lot or street. The developer may remove them at the owner's expense.
- Fences & signs: Fences or obstructions cannot exceed 4 ft in height in front of the house's front corners. Signs are limited to 'For Rent' or 'For Sale' signs no larger than 5 sq ft.
- Temporary structures & debris: No trailers, mobile homes, tents, shacks, garage apartments, barns, or other outbuildings. Rubbish must be kept in sanitary containers. After fire or casualty, debris must be cleared within 90 days.
- Utilities & drainage: The developer reserves easements for utility lines and drainage. Water must be approved by the County Board of Health; sewage must be via approved on-site septic tanks until a community or county system is available.
