Hill Side Subdivision is a single-family residential subdivision in Wilmington, NC. These covenants run with the land and bind all current and future lot owners. The rules are enforced by lot owners, not by a homeowners association.
- Permitted uses & structures: Lots are for single-family residential use only. Only one detached single-family dwelling (max 2.5 stories), a private garage (max 3 cars), and incidental outbuildings (including servant's quarters) are allowed.
- Minimum house size: Each residence must have at least 800 square feet of heated floor space.
- Setbacks & fences: Buildings must be at least 30 feet from the front property line, 10 feet from side boundaries, and 20 feet from side street lines. Fences cannot extend past the front setback line and cannot exceed 4 feet in height.
- Architectural review: Plans for all dwellings and structures must be submitted to the developer (or its agent) for written approval within 10 days; failure to approve within 10 days means automatic approval.
- Nuisances & maintenance: No noxious or offensive activities. No domesticated farm animals or fowls. Yards must be properly maintained; inoperative junk cars and eyesores are prohibited.
- Signs: Only 'For Rent' or 'For Sale' signs are allowed, and they cannot exceed 2 feet by 3 feet.
- Temporary structures: No house trailers, tents, shacks, or temporary structures may be used as a residence, temporarily or permanently.
- Duration & amendment: These covenants run until November 1, 1999, and automatically extend for successive 10-year periods unless 60% of lot owners vote to change them.
