Captains Quarters in Wilmington, NC, is a 24-unit townhome community governed by a homeowners association (HOA). Each owner holds fee simple title to a lot and townhouse, and the association owns and maintains the common elements, including roofs and exteriors. This document is the original 1979 Declaration of Covenants, Conditions and Restrictions, plus a 2014 amendment that removed a right of first refusal on sales and leases.
- What you own & maintain: You own your lot and townhouse in fee simple. The association maintains the common elements (drives, parking, lawns, docks, piers, bulkhead, recreation deck, utilities) and also the asphalt shingle roofs and exteriors of the townhouses. If damage is caused by an owner's willful act or negligence, that owner is personally responsible for the cost.
- Association & assessments: The Captains Quarters Association, Inc. has 24 memberships (one per lot/townhouse). It annually budgets costs and assesses each owner 1/24th of the projected annual costs. Unpaid assessments become a lien on the property and can be foreclosed, but are subordinate to first mortgages.
- Leasing & rentals: The original declaration included a right of first refusal on sales and leases (Section 34), but that section was deleted entirely by a 2014 amendment. The current document does not impose any other leasing restrictions.
