Autumn Creek at Henleigh Hills is a single-family home subdivision in Wilmington, NC. These restrictive covenants run with the land and bind all current and future lot owners. The document sets rules for residential use, construction standards, and property maintenance.
- Residential use only: Lots may be used only for residential purposes. No commercial trade or activity is allowed, and no noxious or nuisance activity may be carried on.
- Building & dwelling requirements: Only one detached single-family dwelling (max two stories) and a private garage (max one story, three cars) are allowed. Minimum dwelling size is 2,000 square feet (excluding porches, garages, carports). Exterior facing the street must be brick or brick veneer. Plans must be approved by the developer (or deemed approved after 20 days if no response).
- Setbacks & lot lines: No building or structure may be located nearer than 10 feet from any side or rear lot line. Eave overhangs up to 3 feet and uncovered stoops/steps are allowed within setbacks. If two adjoining lots are used for one dwelling, the boundary between them is disregarded.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock may be kept. Dogs, cats, or other household pets are allowed, but not for commercial purposes and not in numbers or of a nature that becomes a nuisance.
- Vehicles & parking: Buses, trucks over one ton, unsightly or inoperative automobiles, and similar eyesores cannot be maintained on any lot or street. The developer may remove such vehicles at the owner's expense.
- Fences & obstructions: No fence or other obstruction may extend nearer the street than the front line of the main dwelling.
- Temporary structures & debris: No trailers, mobile homes, tents, shacks, barns, or other temporary structures are allowed except during construction. After fire or casualty, debris must be cleared within 90 days.
- Signs: No signboards are allowed on residential lots except 'For Rent' or 'For Sale' signs.
