Transcom Village at Roymac Business Park is a commercial planned community in Hightsville, NC, governed by a homeowners' association (Transcom Village at Roymac Business Park, Inc.). This document is the Declaration of Protective Covenants that applies to all lots in the development, binding owners, tenants, and occupants. The community is restricted to office, business, and manufacturing uses — not residential.
- Land use & building use: Lots may only be used for offices, business facilities, and manufacturing. No residential, shopping center, or retail food sales without Declarant approval. Hobbies that detract from aesthetics (e.g., auto repair) are not allowed in open areas.
- Architectural review: All construction, exterior changes, landscaping, signs, and site work require prior written approval from the Declarant (or later the Board). Plans must be submitted showing design, materials, and location. The Declarant has sole discretion to approve or disapprove.
- Assessments & fees: Each lot owner must pay general assessments for common expenses (maintenance, insurance, reserves, etc.). A working capital fee equal to 12 months' assessments is due at purchase. Special and individual assessments may also be levied. Unpaid assessments become a lien on the lot.
- Parking & vehicles: No damaged vehicles may be parked in open areas. Delivery vehicles cannot remain in front of buildings for extended periods. No on-street parking by businesses. Parking areas must meet setback requirements and be approved.
- Landscaping & maintenance: All lots must be landscaped per approved plans and kept neatly trimmed and free of trash. Owners must mow regularly and maintain drainage areas. If an owner fails to maintain, the association may do so and charge the owner plus a 15% service fee.
- Signs & advertising: All signs require Declarant approval. No outside storage or displays unless approved in writing.
- Stormwater & environmental: Lots are subject to North Carolina stormwater regulations; built-upon area (impervious surfaces) is limited to 82% of the lot. Drainage swales may not be altered without consent. The state is a beneficiary of these covenants.
- What this document doesn't cover: This document does not address residential use, age restrictions, pet policies, leasing terms, or any residential amenities. It is a commercial development covenant.
