The Landing One is a standard single-family home HOA in Bolivia, NC. This document is the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that binds all homeowners and occupants. It covers use restrictions, maintenance responsibilities, assessments, and enforcement.
- Residential use & home businesses: All lots must be used for single-family residential purposes only. Home businesses are allowed if they are not detectable from outside, comply with zoning, and do not involve regular client visits or door-to-door solicitation.
- Leasing & rentals: Units may be leased for residential purposes only. Leases must require tenants to acknowledge and comply with the governing documents. No minimum lease term is stated.
- Pets: Only usual household pets (dogs, cats, etc.) in reasonable number as determined by the Board are allowed. Pets must be kept in the dwelling, confined to the lot, or accompanied; they must not become a nuisance.
- Construction & minimum home size: Homes must be site-built (no mobile or modular homes) with at least 1,800 square feet of heated floor space. Exterior materials must be brick, wood, stucco, vinyl siding, masonite, or equivalent. Construction must be completed within one year of commencement.
- Assessments & fees: The Board sets annual general assessments equally per lot, plus may levy special assessments (subject to 2/3 member disapproval) and specific assessments for violations. Delinquent assessments accrue interest and late fees, and the Association may file a lien or sue.
- Maintenance responsibilities: The Association maintains common areas including streets. Each owner must maintain their lot and structures to community standards. Undeveloped lots must be mowed at least twice a year; the Association may enter and charge for non-compliance.
- Prohibited uses & nuisances: No firearms discharge, no temporary structures (mobile homes, campers, RVs) as dwellings, no subdivision of lots (except to adjoining owners), and no nuisances such as unsightly conditions, foul odors, or excessive noise.
- Amendment & termination: The Declaration runs for 20 years and auto-renews for successive 20-year periods. It can be amended by 2/3 vote of owners, and terminated after 20 years by 75% of owners.
