What San Rio Ocean & River Club's governing documents say
Solserra (formerly San Rio Ocean & River Club) is a planned community in Bolivia, NC, governed by a homeowners' association (HOA). This document is the master declaration of covenants, conditions, and restrictions (CC&Rs) that applies to all lots and owners in the community. It covers property rights, maintenance responsibilities, assessments, use restrictions, architectural control, and stormwater permit compliance.
- What you own & maintain: You own your lot and any unit on it. The association maintains common elements (roads, landscaping, recreational facilities, stormwater facilities) and may also maintain certain perimeter walls and rights-of-way. You must maintain your lot and structures to the 'Community-Wide Standard' set by the board.
- Assessments & fees: All non-builder owners pay Base Assessments (equal per lot) to fund common expenses, plus possible Special Assessments for unbudgeted costs and Benefited Assessments for specific improvements. Assessments are a lien on the lot. Builder lots are exempt until sold or 24 months after certificate of occupancy.
- Leasing & rentals: The declaration does not specify minimum lease terms or rental restrictions. However, the board may adopt rules regulating leasing. Owners must inform tenants of association rules.
- Architectural review: All exterior changes to lots and units require prior approval under Design Guidelines adopted by the board or an architectural committee. The board may grant variances. No waiver of future approvals is implied by past approvals.
- Use restrictions: Lots are for residential single-family use unless designated as nonresidential. Businesses and trades are prohibited. The board may adopt additional rules. The declaration also restricts display of flags and political signs (per North Carolina law).
- Recreational facilities: The declarant may (but is not obligated to) build amenities like pools, clubhouses, tennis courts, and beach clubs. If built, they are common elements maintained by the association and available to owners of residential units, their families, tenants, and guests. Builders and owners of unimproved lots have limited access.
- Stormwater & environmental covenants: The property is subject to a stormwater permit with specific restrictions: maximum built-upon area per lot (see Exhibit C), 30-foot vegetated buffers from surface waters, and prohibitions on filling or piping drainage swales. These covenants run with the land and cannot be altered without state approval.
- Insurance: The association carries blanket property insurance on common elements, general liability, directors & officers coverage, and crime insurance. Each owner must carry property insurance on their unit and improvements, including windstorm and hail coverage.
