What Eagle Pines's governing documents say
Eagle Pines is a standard single-family home subdivision in Bolivia, NC, governed by a homeowners association (HOA). This document is the full declaration of covenants and restrictions that applies to all lot owners, covering what you can build, how you must maintain your property, and the HOA's powers to assess fees and enforce rules.
- What you own & maintain: You own your lot and the house on it. You must keep your property in good order, including mowing and removing debris. The HOA maintains common areas (like roads and open space) and may bushhog unbuilt lots at least once a year.
- Residential use & building standards: Only single-family homes are allowed. Minimum heated floor area is 1,200 square feet (excluding garage). Roof pitch must be at least 5/12. Exterior materials cannot include concrete block, aluminum, asbestos, or asphalt siding; roofs must be 30-year architectural shingles. Setbacks: 15 ft front, 15 ft side street, 5 ft interior side, 9 ft rear.
- Architectural review: Any exterior change (building, fence, landscaping, mailbox, satellite dish over 18 inches) must be approved in writing by the Architectural Committee before construction. The committee must respond within 15 days. Denial requires specific findings (e.g., negative economic impact, incompatibility). Decisions can be appealed to the Board of Directors.
- Pets & animals: Household pets are allowed but not for breeding or commercial purposes. Pit bull dogs (including Staffordshire Bull Terrier, American Staffordshire Terrier, American Pit Bull Terrier, or mixes) are expressly prohibited. Violators have 24 hours to remove the dog after notice, then a $100/day assessment applies.
- Parking & vehicles: Each dwelling must have a paved driveway and two paved off-street parking spaces (excluding garage). Inoperable vehicles, vehicles without current registration/insurance, and tractor-trailers are not allowed on lots or streets. The HOA may tow such vehicles at owner expense.
- Leasing & rentals: The document does not restrict leasing or set minimum lease terms. (No mention of rental caps or approval requirements.)
- Assessments & fees: Initial annual assessment is $400, plus a $400 capital contribution at closing. The Board can increase assessments up to 10% per year without a vote; larger increases require majority approval. Special assessments for capital improvements need two-thirds approval. Late payments accrue 12% interest and may result in liens and foreclosure.
- Environmental & stormwater rules: Each lot is limited to 3,356 square feet of impervious surface (e.g., asphalt, concrete). A 30-foot vegetated buffer must be maintained along Jump and Run Creek. Conservation areas cannot be disturbed except with Army Corps approval.
