Fountain Head Landing is a planned commercial subdivision in Bolivia, NC, governed by a property owners association. This document is the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that apply to three commercial lots (A, B, C) and bind all owners, tenants, and occupants. It establishes the association, assessments, and use restrictions for the development.
- What you own & maintain: You own your lot in fee simple. You are responsible for maintaining your lot, including driveways, parking areas, landscaping, and any utility/maintenance easements on your lot. The association maintains only the Limited Common Areas (stormwater basins and drainage systems).
- Assessments & fees: The association levies annual general assessments to cover common expenses (stormwater system maintenance, administration, enforcement). Special assessments may also be levied. Unpaid assessments become a lien on the lot and a personal obligation of the owner at the time they fell due.
- Land use & building restrictions: Lots are for commercial uses permitted by the Town of Shallotte zoning ordinance. Impervious surface limits: Lot A – 26,828 sq ft, Lot B – 25,333 sq ft, Lot C – 22,637 sq ft. No temporary or permanent outbuildings without developer approval. All landscaping must be maintained per approved plans.
- Maintenance obligations: Owners must keep lots mowed, clear of debris, and buildings in good repair. If an owner fails to maintain, the association (or developer) may enter, perform maintenance, and charge the owner the cost plus a 15% service fee as an individual assessment.
- Enforcement & penalties: The association can enforce rules through legal action, fines, suspension of voting rights, and lien foreclosure. Fines not paid within 15 days become an individual assessment. The association may also remedy violations and charge the owner.
- Duration & amendments: The covenants run for 20 years from recording (2009) and auto-renew for successive 20-year periods unless a majority of owners vote to revoke. Until December 31, 2012, or until all lots are sold, the developer could amend unilaterally; thereafter, amendments require a majority vote of owners and recording.
- What this document doesn't cover: This document does not address residential use, age restrictions, leasing/rental terms, pet policies, or architectural review procedures. It applies only to the three commercial lots and does not cover any residential lots that may exist elsewhere in the subdivision.
