This is an amended declaration of covenants, conditions, and restrictions for South Bridge (formerly Lennon Hills), a planned community in Bolivia, NC, governed by the North Carolina Planned Community Act. It applies to all lot owners in the community, which includes single-family homes and townhomes, and establishes a master homeowners association. The document sets out property rights, assessments, use restrictions, architectural review, and a conservation area.
- Community type & governance: South Bridge is a planned community with a master homeowners association. The developer (Declarant) retains control until certain conditions are met, and may annex additional property. The association maintains common elements and limited common elements (e.g., townhome exteriors).
- What you own & maintain: You own your lot and dwelling. For townhomes, the association maintains the exterior (roofs, siding, decks, porches, gutters, yards within privacy fences). For single-family homes, you maintain your own property. The association maintains common elements like roads, stormwater ponds, and open space.
- Assessments & fees: All lot owners pay annual common element assessments. Townhome owners also pay annual limited common element assessments. Special assessments require 2/3 vote of affected members. A one-time working capital assessment of $200 is due at closing. Assessments are liens if unpaid.
- Leasing & rentals: Leases must be for at least 4 months. All leases must be in writing, include a clause requiring tenant compliance with rules, and be submitted to the association. Transient (short-term) rentals are strictly prohibited.
- Architectural review: All exterior changes (structures, painting, fences, landscaping) require prior written approval from the Architectural Review Committee. The committee has sole discretion based on aesthetics. Minimum dwelling size is 1,200 sq ft (may be reduced 10% by committee).
- Use restrictions: Lots are for residential use only (one single-family dwelling per lot). No boats, campers, trailers, or inoperable vehicles may be stored on lots or streets. No outdoor antennas or satellite dishes over 18" visible from the street. No clotheslines. Trees 6" diameter or larger may not be cut without approval.
- Pets & animals: Household pets (dogs, cats) are allowed but not for commercial purposes. They must be leashed and not become a nuisance. No livestock or poultry.
- Golf course & conservation area: A 9-hole par-3 golf course is planned, with initial monthly maintenance fee of $25. A 12-acre conservation area (wetland mitigation) is permanently restricted from development, with no public access.
