Avalon Of The Carolinas is a planned community in Bolivia, NC, governed by a homeowners association (HOA). This document is the amended and restated declaration of covenants that applies to all lot owners, their tenants, and guests. It establishes rules for residential use, architectural review, maintenance responsibilities, and association assessments.
- What you own & maintain: You own your lot and the dwelling on it. You must maintain your lot, including landscaping, exterior painting, and repairs. The association maintains common areas, roads, stormwater facilities, and entry features.
- Architectural review: No exterior changes (fences, landscaping, paint, etc.) may be made without prior written approval from the Declarant (D.R. Horton) or, after the Declarant Control Period, an Architectural Review Committee (ARC). Approval decisions are based on aesthetics and are final.
- Leasing & rentals: Leases must have a minimum term of six months. The association may regulate leasing but cannot prohibit it or require consent to lease.
- Occupancy & use: Each lot may be occupied only by a single family: individuals related by blood, marriage, adoption, or guardianship, or up to three unrelated persons living as a single housekeeping unit. Home businesses ancillary to residential use are allowed subject to rules.
- Parking & vehicles: Only licensed, operative passenger vehicles may be regularly parked in driveways. No regular parking on roadways. Recreational vehicles must be screened from view. No vehicle may be used as a dwelling.
- Assessments & fees: The association levies annual Base Assessments equally per lot to fund common expenses. Special assessments may be levied for unbudgeted expenses. Late charges up to $20/month or 10% of unpaid installment, interest up to 18% per annum, and collection costs apply. Assessments are a personal obligation and a lien on the lot.
- Signs & displays: No signs or advertising visible from public view except for professionally prepared for-sale or for-rent signs no larger than 18" x 24". Religious and holiday displays inside dwellings are permitted if they meet community standards.
- Insurance: The association carries property insurance on common areas, liability insurance, and directors & officers coverage. Each owner must maintain hazard insurance on their own dwelling and personal property, and name the association as an additional insured.
