What Riversea Plantation's governing documents say
Riversea Plantation is a subdivision in Bolivia, NC, governed by a Declaration of Covenants, Conditions and Restrictions. This document is the Eighth Amendment to that declaration, which adds restrictions on designated wetlands and marshes to satisfy federal requirements. It binds all lot owners and is supplemental to the original declaration.
- Wetlands & marshes restrictions: In areas designated as conservation wetlands, wetlands, or marsh, the following are prohibited: industrial/commercial use; residential use (unless authorized by governing documents); agricultural, timber harvesting, and grazing; disturbance of natural features, plants, and animals (except for fire protection, disease control, restoration, or non-native plant control); construction of buildings, pavement, signs, antennas, piers, docks, or other structures; roads, trails, or walkways; filling, excavation, dredging, mining, or removal of topsoil or minerals; pollution or alteration of water bodies; dumping of trash, waste, or abandoned items.
- Permitted activities in wetlands: A lot owner who obtains a permit from the U.S. Army Corps of Engineers and/or the North Carolina Department of Environment and Natural Resources to construct a pier, dock, or similar improvement may be granted a 10-foot-wide construction easement over conservation wetlands, wetlands, or marsh as necessary to build the improvement consistent with the permit.
- Enforcement & remedies: The U.S. Army Corps of Engineers, its employees, agents, and assigns have the right to enter wetlands or marsh at reasonable times to inspect compliance. However, the Corps cannot bring action against the Declarant or members for injury or change caused by fire, flood, storm, or prudent emergency actions taken in good faith.
- What this document doesn't cover: This is only the Eighth Amendment to the declaration. It does not contain the full set of community rules, such as architectural review, parking, pets, leasing, or assessments. Those are found in the original Declaration and its other amendments.
