Charleston Common at Jackeys Creek is a townhome community in Leland, NC, governed by a homeowners association (HOA). You own your lot and townhome unit, and the association maintains common areas, landscaping, and private streets. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all owners.
- What you own & maintain: You own your lot and townhome unit. You are responsible for exterior maintenance of your unit (paint, roof, windows, doors, fences, mailboxes, etc.). The association maintains landscaping, irrigation, common staircases, private streets, and common elements.
- Leasing & rentals: Leases must be for at least 12 months unless the board approves a shorter term. Each lease must state it is subject to the declaration and bylaws, and the association can enforce rules against tenants.
- Pets: Dogs, cats, and usual household pets are allowed but not for commercial purposes. They must be controlled per local ordinances and not be a nuisance.
- Parking & vehicles: Each townhome has a parking area underneath. No campers, motorhomes, commercial trucks, or tractors may be parked on the property. Boats and boat trailers may be parked under the townhome, stored to the rear of the parking bay. Street parking is not allowed unless permitted by the association.
- Architectural review: Any exterior changes (buildings, fences, signs, landscaping, etc.) require prior written approval from the board or an architectural committee. Approval may be based on aesthetics. If no decision is made within 30 days of complete submission, approval is deemed given.
- Assessments & fees: Monthly assessments started at a maximum of $90 per unit in 2009 and can increase up to 10% per year without a member vote. Special assessments for capital improvements require a 2/3 vote of each class, except the board can approve up to $100 per unit per year without a vote. A two-month working capital fee is due at initial sale.
- Use restrictions: Property is for single-family residential use only. No businesses, signs (except approved), or activities that increase insurance rates or create nuisances. No window screens on the front of units. The board can adopt rules and impose fines for violations.
- Insurance & casualty: The association carries liability insurance (at least $1 million per occurrence) and fire/hazard insurance on all buildings at full replacement value. After a casualty, the association must repair/restore within 270 days. Owners are not assessed for insurance proceeds used for repairs.
