What Sea Oats Club's governing documents say
Sea Oats Club is a fractional-ownership resort community in Wrightsville Beach, NC, where each luxury beach house is owned by up to ten tenants-in-common. Each owner buys a 1/10th undivided interest that grants the right to use a specific house for four assigned weeks per year (one each from Spring, Summer, Fall, and Holiday seasons) plus at least one Winter Bonus Week. This document is the master declaration that sets up the co-ownership structure, use rights, management by a Managing Agent, and restrictions—it does not contain the full rules for the broader Sea Oats community (which are in a separate recorded declaration).
- What you own & use rights: You own a 1/10th undivided fee simple interest in a specific lot and house, plus a perpetual easement for a porch/deck area. Your use right is four Season Weeks per Club Year (one from each of Spring, Summer, Fall, and Holiday seasons) assigned by a rotating number system, plus at least one Winter Bonus Week on a first-come basis. You may also exchange weeks with other owners in your house or, by 2/3 vote, with other houses or external exchange programs.
- Occupancy & rentals: You may occupy only during your assigned Use Period(s) unless you exchange with another owner. You may rent your Use Period(s) to others, but you remain responsible for any damage or rule violations. The maximum number of occupants is set by the Rules and Regulations. All occupancy must comply with local zoning (e.g., single-family).
- Pets: No animals, livestock, birds, fish, poultry, dogs, cats, or household pets of any kind are allowed in or upon the property.
- Alterations & decor: You may not paint, repaint, tile, paper, refinish, or redecorate interior surfaces, landscape, or remove/alter/replace any Common Furnishings without the Managing Agent's prior written consent. The Managing Agent has sole authority over such work.
- Sale & transfer restrictions: You cannot transfer less than a full 1/10th interest. Before selling, you must first offer the interest to the Declarant (or its assignee) in writing; Declarant has 15 days to accept. If Declarant declines, you may sell within the next 90 days on terms no more favorable than those offered to Declarant. Any transfer not complying is void.
- Fees & assessments: Each owner pays an annual Maintenance Fee (payable in installments) to cover operations, utilities, cleaning, maintenance, reserves, mortgage payments, taxes, and the Managing Agent's fee. Special Assessments may be levied if funds are inadequate. Personal Charges (e.g., damage, long-distance calls) are billed separately. Delinquent fees bear interest and may become a lien on the interest.
- Management & enforcement: The Managing Agent (initially engaged by Declarant) handles all maintenance, repairs, furnishings, rules, insurance, and fee collection. The Managing Agent may enter units for repairs, emergencies, or abating nuisances with reasonable notice. Violations can be enforced by damages, injunction, lien foreclosure, or suspension of privileges. The Declarant also retains enforcement rights while it holds any interest.
- What this document doesn't cover: This declaration does not contain the full set of covenants for the broader Sea Oats Club common area (which is governed by a separate recorded declaration). It also does not include the current Rules and Regulations, Occupancy Agreement, or specific fee amounts—those are established separately by the Managing Agent.
