What Southgate's governing documents say
Southgate is a single-family home subdivision in Pharr, Texas, governed by a homeowners association (Southgate Property Owners Association). The community is age-restricted for adults 55 and older, with no one under 18 allowed to reside. These rules apply to all lot owners, their tenants, guests, and family.
- Age restriction (55+): The subdivision is operated as a community for older adults. At least one occupant per lot must be 55 or older, and no one under 18 may reside there (visits by minors are allowed). Owners who were already living there when the rule took effect are grandfathered in.
- What you own & maintain: You own your lot and home. The association owns and maintains common areas. Owners must keep their yards clean and free of inoperative junk cars and eyesores.
- Architectural review: All building plans must be approved before construction by the developer or its agent. The developer also has absolute control over the site and location of any structure.
- Building & exterior standards: Homes must be at least 1,000 square feet (excluding porches, garages, etc.). Exteriors must be conventional frame or clay brick; concrete block, asbestos siding, and composition tar paper are prohibited. Fences cannot exceed 4 feet in height and must be set back from the front lot line to at least the front corners of the house.
- Prohibited structures & uses: No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences. No noxious or offensive activities, and no domesticated farm animals or fowls are allowed.
- Signs: Only private name plates, identification signs, and 'For Rent' or 'For Sale' signs are permitted.
- Utilities: Water must come from the community water system unless approved otherwise. An 8-foot radius around each water meter is an easement for maintenance. The developer may require underground electric and street lighting, with costs paid by lot owners.
- Enforcement & assessments: The association or any lot owner can sue to enforce the rules. The board can levy special assessments of up to $100 per improved lot per year for capital improvements, and an additional $100 per year to fund enforcement of the age restriction. Violators may be liable for attorney's fees.
