What Piney Woods's governing documents say
Piney Woods is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1971. These restrictions apply to lots 1-14 in Section 'I' and are binding on all owners. The document sets rules for residential use, building size and placement, and architectural review.
- Residential use only: Lots 1-14 must be used for residential purposes only. Only one detached single-family dwelling and a one- or two-car garage may be built per lot.
- Building size & height: Dwellings cannot exceed two and a half stories. Minimum interior floor area is 1,200 square feet, though the developer or committee may approve smaller homes with additional porch or garage space under the main roof.
- Setbacks & lot lines: Buildings must be at least 50 feet from the front street line and at least 10% of the lot's width from adjacent property lines.
- Architectural review: Building designs must be approved by the developer or a committee. Plans must be submitted in writing; if not approved or disapproved within 10 days, approval is not required as long as the design is in harmony with existing structures. Approved materials include wood, stone, brick, brick veneer, tile and stucco, concrete, or asphalt shingles.
- Prohibited structures & uses: No trailer, basement, tent, shack, garage, barn, or other out-building may be used as a residence. Lots cannot be re-subdivided unless the subdivided part becomes part of a whole lot.
- Drainage & utilities: Owners must install and maintain a culvert or drainage pipe at least 12 inches in diameter under their driveway to maintain natural drainage. Until municipal sewer is available, septic tanks must meet state health board approval.
- Enforcement: Any property owner in the subdivision may sue to enforce these restrictions or recover damages for violations.
- What this document doesn't cover: This document does not create a homeowners association, set fees or assessments, regulate leasing or rentals, restrict pets, or address parking beyond driveway drainage. It is a set of deed restrictions, not a full HOA rulebook.
