What Passage Point Condominium's governing documents say
Passage Point Condominium is a condominium community in Wilmington, NC — you own your individual unit and share ownership of the building's common elements, which the association maintains. The declaration governs all unit owners and residents.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings). The association maintains all common elements, including structural components, roofs, hallways, pool, and landscaping. Limited common elements like balconies, patios, and HVAC systems are your responsibility for routine maintenance, but the association handles major repairs.
- Leasing & rentals: During the Declarant Control Period, no unit may be leased for less than six months. After that period, the association may set policies, but a minimum lease term longer than six months requires unanimous owner consent. Leasing cannot be prohibited entirely without all owners' written consent. Owners must provide lessee contact info and a copy of the rules.
- Pets: Only small common household pets (dogs, cats, fish, and other species approved by the board) are allowed, not for commercial purposes. Pets must be leashed or carried on common elements. Owners must clean up after pets and register them with the association. After two violations in 12 months, the association may require permanent removal.
- Parking & vehicles: Parking is subject to rules set by the declarant or association. No boats, trailers, motor homes, campers, or recreational vehicles may be stored on the property. The association may tow violating vehicles at the owner's expense.
- Architectural review: No exterior additions, changes, or alterations may be made without prior written approval from the association. This includes satellite dishes, antennas, window coverings, and flags. Satellite dishes must meet specific criteria and cannot penetrate the roof.
- Use restrictions & quiet hours: Units are for residential use only (home offices allowed with restrictions). Quiet hours are 10 p.m. to 10 a.m. No obnoxious or unlawful activities. Second and third floor units must cover at least 70% of foyer, dining, and living room floors with rugs to dampen noise.
- Balconies & patios: Balconies and patios must be kept clean and orderly. No storage of bicycles, garbage, or laundry drying. No gas or charcoal grills (electric grills permitted). No fake flowers or greenery. Flags may be displayed on national holidays with approved mounting.
