The Marshes at Rivers Edge is a condominium community in Wilmington, NC — you own your individual unit and share ownership of the building's common elements, which the association maintains and insures. This declaration governs all unit owners and occupants, and includes rules on use, leasing, pets, and assessments.
- What you own & maintain: You own the interior of your unit (including interior surfaces and fixtures). The association maintains and insures the common elements (shared areas, building exterior, etc.). You must maintain your unit in good condition and pay for repairs caused by you or your guests.
- Leasing & rentals: Leases must be for at least 30 days (no transient or hotel use). Leases must be in writing, cover the entire unit, and comply with the declaration and bylaws. You must notify the association of the lessee's name, unit, and lease term. Subleases require board approval.
- Pets: You may keep up to two dogs, two cats, or other household pets, but no more than three total animals. Pets cannot be kept for commercial purposes. The board may exclude any pet it deems a nuisance.
- Assessments & fees: The board can levy assessments for common expenses, which become a lien on your unit if unpaid. Delinquent assessments do not automatically transfer to a new owner unless assumed. A first mortgagee who acquires title is only liable for assessments that become delinquent after acquisition.
- Use restrictions: Units are for residential use only. No 'For Sale' or 'For Rent' signs without board approval. No hazardous activities or nuisances. Outside antennas and satellite dishes require board permission.
- Alterations & common elements: You cannot alter common elements without board approval. Unit alterations are subject to the bylaws and the North Carolina Condominium Act.
- Insurance: The association carries casualty insurance on the property and public liability insurance (minimum $1 million per occurrence). You may obtain your own insurance for personal property and liability.
