Noremac Hills is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants recorded in 1965. These rules apply to all lot owners in the subdivision and are designed to maintain a residential character.
- Residential use only: All lots must be used solely for residential purposes. No commercial or other non-residential uses are permitted.
- Minimum house size: Any residence built must have at least 1,400 square feet of floor space on the main floor, not counting porches, steps, walks, breezeways, carports, garages, etc.
- One house per lot: Only one residence may be built on each lot, unless the owner combines two or more lots for a single residence.
- Setback requirements: Buildings must be at least 10 feet from side property lines and at least 50 feet from the front property line. If two or more lots are combined, the interior boundary lines are ignored for setback purposes.
- No temporary structures: No house trailers, tents, shacks, or temporary structures may be used as a residence or placed on any lot.
- Architectural approval: The design of all buildings must be approved by the developer or its agents before construction.
- Amendment and duration: These covenants run with the land and automatically renew every 10 years after 1985 unless a majority of lot owners vote to change them. They can also be amended by the developer and owners of at least 60% of the lots.
- Enforcement: Any owner in the subdivision can sue to enforce these covenants or recover damages for violations.
